Özet
Bütün toplumların, bireylerin güvenliği ve huzuru için koymuş olduğu hukuk kuralları vardır. Bu kurallara uyulmadığı takdirde birtakım müeyyidelerle karşılaşırlar. İnsanlar bu kuralların hürriyetlerini kısıtladıklarını düşündükleri için de birtakım hilelere başvururlar. Bu hileler İslam hukukunda kanuna karşı hile ve hile-i şer'iyye olmak üzere iki kısma ayrılır. Kanuna karşı hilenin örneklerinden biri de hülle nikahıdır. Yazar, eserinde hülle nikahı örneği bağlamından yola çıkarak hilenin tanımlarını ve çeşitlerini açıklamıştır. Kanuna karşı hile ve hile-i şer’iyyenin dayanaklarını ve çeşitlerini detaylı örnekler ile değerlendirmiştir. İlaveten hülle nikahının yasaklanma sebeplerini tarihten örneklerle açıklamıştır. Bu nikahın niçin yaygınlık kazandığı ve toplumsal, kişisel problemlere yol açmasının sebepleri de okuyucuya sunulmuştur.
All societies have rules of law for the security and peace of individuals. If these rules are not followed, they face certain sanctions. Since people think that these rules restrict their freedoms, they resort to certain tricks. In Islamic law, these tricks are divided into two parts: cheating against the law and hile-i shar'iyya. One of the examples of cheating against the law is hülle marriage. In his work, the author explains the definitions and types of cheating based on the context of the example of khulla marriage. He evaluated the bases and types of fraud against the law and hile-i shar'iyya with detailed examples. In addition, he explained the reasons for the prohibition of khulla marriage with examples from history. The reasons why this marriage became widespread and caused social and personal problems are also presented to the reader.
