| dc.description.abstract | Amirin emrine uyma zorunluluğunun kapsamı, başka bir deyişle emre uyma zorunluluğunun içerdiği ve dışarıda bıraktığı durumların ortaya konulması, hukuk devletinde kamu görevlilerinin hukuka uygun idari faaliyetler yürütmesi bakımından önem arz etmektedir. İdari faaliyetin düzenli bir şekilde yürütülmesi için yetki paylaşımını gösteren hiyerarşi ilişkisinde ast, amirin emri ile bağlıdır. Aynı zamanda kamu görevlileri, hukuka aykırı eylem ve işlemlerinden dolayı sorumludur. Bu çatışma, hukuk düzeninde kanunsuz emir kurumu ile uzlaştırılmaktadır. Çalışmada, kamu görevlisinin, emrin hukukiliğini değerlendirme yükümlülüğünü yerine getirmesinin gündelik hayattaki güçlükleri göz ardı edilmeden amirin emrine uyma zorunluluğunun kapsamı ve bu kapsamı oluşturan hukuki kurumların işlerliği için getirilen öneriler ele alınmaktadır. | |
| dc.description.abstract | Scope of subordinate's obligation to comply with orders,in other words, revealing the situations that the obligation to comply with the order includes and excludes is important for public officials to carry out administrative activities in accordance with the law in the state of law.Subordinates bound by the superior orders in the hierarchy relationship, which indicates authority sharing for the regular execution of administrative activity.Also, public officials are responsible for their unlawful actions and transactions.This conflict, is reconciled in legal order with the concept of unlawful order.In this study,the scope of the obligation to comply with the orders of the superior was examined without ignoring the difficulties in daily life of the public official fulfilling the obligation to evaluate the lawfulness of the order and the suggestions for the functioning of the legal institutions that make up this scope are discussed. | |
