dc.description.abstract5237 sayılı Türk Ceza Kanunu’nun 190. maddesinin 2. fıkrasında düzenlenen uyuşturucu veya uyarıcı madde kullanılmasını özendirme suçu; madde kullanımının kişinin sağlığına ve genel ölçekte topluma verdiği zarar sebebiyle ve uyuşturucu ve uyarıcı maddelerin çeşitliliğinin hızlı bir şekilde artması, bunlara erişimin kolaylaşması, kullanımının yaygınlaşması neticesinde madde kullanılmasına karşı etkin mücadele yürütülmesi amacıyla ihdas edilmiş bir düzenleme olup devletin bu hususta gerekli tedbirleri alma yönünde pozitif yükümlülüğünün bir yansıması olarak karşımıza çıkmaktadır. Son yıllarda, özellikle teknolojinin gelişmesi ve sosyal platformlar aracılığıyla belirsiz ve çok sayıda kişinin hızlı bir şekilde bu mecralarda yayınlanan içeriğe erişiminin mümkün hale gelmesiyle; uyuşturucu veya uyarıcı madde kullanımına yönelik ifadeler veya içerikler sebebiyle bu suç tipi sık sık gündeme gelmektedir. Çalışmamız kapsamında mevcut hukuki durum ışığında, daha açık ve detaylı bir norm gerekliliği ortaya konarak, yeni bir düzenlemeye ihtiyaç olup olmadığı tartışılacaktır.en_US
dc.description.abstractThe crime of inciting the use of narcotic or psychotropic substances in the Turkish Penal Code No. 5237 (art. 190/2) is a regulation that aims to effectively fight this crime due to the harm caused by substance use to individuals and society, combined with the rapid increase in the variety of narcotic and psychotropic substances, the ease of access to as well as the widespread use of them; it is thereby a reflection of the positive obligation of the state to take the necessary measures in this regard. In recent years, especially with the development of technology and the use of social platforms, it has become possible for a large number of people to rapidly access the content broadcasted on these media, which is why this type of crime frequently comes to the fore because of the expressions or contents about the use of narcotic and psychotropic substances. Within the scope of our study, in light of the current legal situation, the necessity of a clearer and more detailed norm, and whether there is a need for a new regulation will be emphasized.en_US
