| dc.description.abstract | İddianamenin mahkeme tarafından kabulü ile başlayıp, mahkemece verilen hükmün kesinleşmesi ile sona eren kovuşturma evresinin en önemli aşamalarından birisini şüphesiz duruşma aşaması oluşturmaktadır. Duruşma sırasında muhakeme süjelerinin katılımı ile deliller mahkeme önünde tartışılmakta ve bu tartışmadan edindiği kanaate göre de mahkeme kararını vermektedir. Bur tartışmanın da belli bir usule göre yapılması gerekmektedir. Bu çalışmada Ceza Muhakemesi Kanunumuzun Üçüncü Kitabı altında düzenlenmiş olan duruşmanın yürütülmesine ilişkin konular uygulamacı gözüyle açıklanmaktadır. Bu kapsamda duruşmaya hakim olan ilkeler, duruşmanın ne zaman başlamış sayılacağı, duruşmada düzen ve disiplinin sağlanmasında mahkeme başkanının yetkileri incelenmiştir. | |
| dc.description.abstract | One of the most important stages of the prosecution phase, which starts with the acceptance of the indictment by the court and ends with the finalization of the judgment rendered by the court, is undoubtedly the trial phase. During the hearing, the evidence is discussed before the court with the participation of the subjects of the proceedings and the court renders its decision according to the opinion it gains from this discussion. This discussion must also be conducted according to a certain procedure. In this study, the issues related to the conduct of the trial, which are regulated under the Third Book of our Criminal Procedure Law, are explained from the practitioner's point of view. In this context, the principles governing the hearing, when the hearing is deemed to have started, and the powers of the presiding judge in ensuring order and discipline in the hearing are examined. | |
