Abstract
Bilgi teknolojisi olarak adlandırılan günümüz çağı, çok değişik yazılarla anlatılmaktadır. Bilgi teknolojisi, bizim yaşam tarzımızı, giyimimizi, alışkanlıklarımızı köklü bir şekilde değiştirdi. Sadece son 10 yıldır gözüken bazı davranış değişiklikleri, cesur yazarların hayal güçlerinin meyvelerdir. Bu yeni bilgi teknolojisinin yol açtığı gelişim, „telematika? denilen bir yeniliğe gelecekteki yolumuzu açar. Telematika terimi, „otomatik bilgileri taşıyan bir bilgisayar dilinin kullanımı vasıtasıyla uzağa düşünce aktarımının teknolojik yöntemi? şeklinde tanımlanır. Telematika'da bilgilerin aktarılması, dolaysızdır ve hemendir. Yeni teknolojinin oluşturulması, faydalı ve gerekli olmalarının yanı sıra yeni suçlara kapı aralar. İnsan tarafından yapılan bilimin farklı unsurları, gerçekten bu unsurlar önceden tasarlandıkları şekilleriyle, farklı alanlara yönlendirilebilirler ve aynı amaçları gerçekleştirmede, fikir sahiplerinin niyetleri doğrultusunda, kayda değer şekilde farklı yönlere sapılır. Toplum bilimi asla, dijital teknolojide suçun yasal oluşumunu tanımlama konusunda çalışan suç biliminin uğraş alanı değildir2 . Bir normun hazırlanması aşamasında, suç kapsamına girecek yeni davranışların kabul edilmesi söz konusu olsa, bu konuda doktrinde iki ayrı fikir ortaya çıkar. Bunlardan ilki, daha yenilikçi bir görüşü benimser. Bu görüşe göre, „hukuki menfaat bilgi işlemi? olarak adlandırılan yeni bir hukuki menfaat alanında, yenilik gereksinimi temelinde, eskiyi yeniye çevirme ve bundan dolayı yeni bir yasal organın (normun) yaratılması gerekir. Bütün yeni düzenlemeler konusunda, ceza kanununun özerk bir başlığının oluşturulması kapsamında, yenileme (yenilik), zorunluluk olarak düşünülmektedir. İkincisi ise, tutucu olarak tanımlanır. Bu görüşe göre, halihazırda korunan hukuki menfaatin aynı olması gerektiği düşünülmektedir.

The first is a more innovative adopts the view. According to this view, it is defined as 'legal interest information processing'. on the basis of the need for innovation, in a new field of legal interest called converting the old to the new and therefore the creation of a new legal body (norm) must be created. With regard to all new regulations, the penal code is autonomous. within the scope of the creation of a title, renewal (innovation), as a necessity is considered. The second is defined as conservative. According to this view, It is considered that the currently protected legal interest should be the same.
