dc.description.abstractSatış sözleşmesinin konusunu çoğunlukla sözleşmenin kurulduğu sırada mevcut olan bir malvarlığı değeri oluşturmakta ve satıcı sözleşmenin kurulduğu anda satılanın bulunduğu şekliyle devrini taahhüt etmektedir. Nitelikli satış sözleşmesinde ise sözleşmenin kurulduğu zaman diliminde henüz mevcut olmayan bir malvarlığı değerinin alıcının siparişi üzerine üretilerek devri üstlenilmektedir. Bu bakış açısından konu değerlendirildiğinde sözleşmenin niteliğinin belirlenmesinde önemli olan sözleşmenin kurulmasından sonra üretilecek bir şeyin sözleşmeye konu olmasıdır. Taraflarca aksi kararlaştırılmış olmadıkça satılan bizzat satıcı tarafından üretilebileceği gibi üçüncü bir kişi tarafından da üretilebilir. Sözleşmenin konusunun satıcı tarafından üretileceğinin kararlaştırıldığı yahut satıcının dürüstlük kuralı gereği sözleşmenin konusunu oluşturan malvarlığı değerini üretmekle yükümlü olduğu durumlarda, üretim yükümlülüğü satıcı bakımından bir yan yükümlülük niteliğindedir.en_US
dc.description.abstractThe subject of the sale contract is mostly an asset which existed at the time of forming the contract. The seller undertakes to transfer the sold product as is at the time of the formation of the contract. In the qualified sales contract, an asset that did not exist at the time of forming the contract is produced on the order of the buyer and the transfer is undertaken. From this point of view, the important thing in determining the nature of the contract is that something is to be produced after the formation of the contract is the subject of the contract. Unless otherwise agreed by the parties, the sold product can be produced by the seller or by a third party. In cases where it is decided that the subject of the contract will be produced by the seller or the seller is responsible for producing the subject of the contract due to the rule of honesty, the obligation of producing is a secondary obligation for the seller.en_US
