6284 Sayılı kanunda şiddet ve istanbul sözleşmesinin tck açısından değerlendirilmesi

Özet
Şiddet insan yaşamının her alanında görülebilen ve dünyanın da önemli bir sorunudur. Şiddetin en fazla görülen şekli ise aile ortamında ve kadına yönelik şiddettir. Kadına yönelik şiddet, Türkiyede de önemli bir sorundur. Türkiyede hemen her gün kadına yönelik şiddet haberleri duyulmaktadır. Kadına yönelik şiddet konusunda 2012de yaklaşık 25 bin kadın mağdur olmuştur. Türkiye bu sorunla mücadele etmek için çeşitli alanlarda çalışmalar yapmaktadır. Bunlardan birisi de hukuki alanda yapılan düzenlemelerdir. Bu alanda iki özel kanun yapılmıştır. Bu kanunlardan 6284 sayılı Ailenin Korunması ve Kadına Karşı Şiddetin Önlenmesine Dair Kanun halen yürürlüktedir. Kanunla tüm şiddet mağdurlarının korunması hedeflenmiştir. Yalnızca şiddete uğrayanlar değil, aynı zamanda şiddete uğrama tehlikesi bulunan kişiler de korunmaktadır.Ancak, 6284 sayılı Kanunda suçlar bağlamında belirlemelere gidilmemiştir. Bu konuda ceza kanunu hükümleri geçerli olacaktır. Ceza Kanundaki bazı belirlemeler ise, Kadına Yönelik Şiddet ve Aile İçi Şiddetin Önlenmesi ve Bunlarla Mücadeleye Dair Avrupa Konseyi Sözleşmesinin içerdiği ve yapılması istenen bazı düzenlemeleri karşılamamaktadır. Bu çalışmada 6284 sayılı Kanunda yer verilen bazı belirlemelerin ceza hukuku çerçevesinde ve Avrupa Konseyi Sözleşmesi hükümleri doğrultusunda değerlendirilmesi yapılacaktır.
Violence creates a problem in the world which may be observed in all fields of human life. And the most common form of violence is against women and in family environment. Violence against women is an important problem in Turkey as well. News on violence against women is heard in Turkey almost every day. Approximately 25 thousand women were aggrieved in 2012 for violence against women. Turkey is performing studies in various fields in order to struggle against this problem. One of them is the regulations made in the legal field. Two special laws were enacted in this field. Law on Protection of the Family and Preventing Violence against Women numbered 6284 is in force currently. Protection of all persons aggrieved of violence was targeted with this law. Not only persons suffering from violence but also those who are under the risk of suffering from violence are protected. However, no determination was made within the context of crimes in the Law numbered 6284. The provisions of the Criminal Code shall be valid. And certain determinations in the Criminal Code fail to respond certain regulations contained in and required by the European Council Act on Preventing Domestic Violence and Violence against Women and Struggling against These.In this study evaluation of determinations that take place in the Law numbered 6284 will be made within the framework of Criminal Law and in accordance with the Provisions of Istanbul Covenant.
