Abstract
İstinaf, ilk derece mahkemelerinin kararlarından bir üst merci olarak bölge adliye (istinaf) mahkemelerine başvurulması yoludur. Gelişmiş hemen her ülkenin yargı sisteminde bulunan istinaf kanun yolu ilk derece mahkemeleri ile temyiz mahkemesi arasında yer almaktadır. Hukuk devletinin gereklerinden kabul edilen istinaf, davaların ikinci kez daha tecrübeli ve bilgili hakimler tarafından görülmesi imkanını sağladığı için hak arayanlar bakımından bir teminat işlevini görmektedir. İstinaf mahkemeleri yargılama usulüne göre hem ilk derece mahkemeleri hem de temyiz mahkemelerinden farklılık arzetmektedir. Bu mahkemelerde davalar ne ilk derece mahkemelerinde olduğu gibi baştan sona yeniden görülmekte, ne de temyiz mahkemelerinde olduğu gibi sadece hukuki denetimle yetinilmektedir. İstinaf aşamasında maddi ve hukuki meseleler birlikte incelendiği için hak arayanların adli gerçeğe ulaşmaları daha da kolaylaşmaktadır. Azerbaycan Hukukunda üç dereceli yargılama sistemi mevcut olup, istinaf mahkemeleri ikinci derece mahkemeleri temsil etmektedir. Türk Hukukunda da gerçekleştirilen adli reformlar sayesinde uzun aradan sonra istinaf mahkemeleri yeniden yürürlüğe konulmuştur.
Appeal is the method of applying to the courts of appeal as an upper authority from the court of first instance decisions. Almost every developed country judiciary system includes appellation procedure and it exists between court of fisrt instances and supreme court. In a state governed by the rule of law appeal is one of the requirements, because appeal functions as an assurance from the standpoint of declarators by affording an opportunity for the trials to be rewieved second time by the more experienced and proficient judges. From the viewpoint of proceeding, appellate courts have distinctions from both courts of first instance and supreme courts. In these courts cases do not take place as none of them: neither as the courts of first instance where court cases occur from the beginning to end once again nor as it happens in the supreme courts; cases are to be contented with the judicial supervision. In the appellate stage judicial and substantive issues are investigated together and this reality eases to attain judicial truth by declarators. In Azerbaijan Law system exists three stages of jurisdiction, appellate represents the second stage courts. In Turkish Law system through the judicial reforms after a long time period appellate courts are put in force once again.
