| dc.description.abstract | İnsanlar, toplum içinde yaşadıkları süre boyunca sahip oldukları malları korumak ve güvenliğini sağlamak istemişlerdir. Bu istek, mülkiyet kavramının doğmasına ve gelişmesine yol açmıştır. Mülkiyet, bir kişi ile nesne arasında kurulan ve diğer insanlarca kabul edilen bir aitlik ilişkisidir. Bir nesnenin kime ait olduğunu bilmek hem bireysel hem de toplumsal açıdan önemlidir. Bu nedenle mülkiyet kavramı hem özel hukuk hem de kamu hukukunda farklı yönleriyle ele alınmış ve düzenlenmiştir. Özel hukukta mülkiyet hakkı, kişinin mal üzerindeki en geniş yetkisini ifade ederken, kamu hukukunda mülkiyetin sınırları, devletin yetkileri ve kamu yararı ile belirlenmiştir. Bütün bu düzenlemelerin amacı, bireylerin mallarına yönelik oluşabilecek tehlikelere karşı bir önlem oluşturmak ve mülkiyetin kötüye kullanılmasını önlemektir. Bireylerin sahip oldukları malların güvence altına alınması hususunda oluşabilecek tehlikelere karşı önlem oluşturmak ve gerektiğinde yaptırım uygulamak maksadıyla tamamen kamu düzenini sağlamak ve kamu yararına hizmet etmek amacıyla hukuki düzenlemeler getirilmiştir. 5237 sayılı kanunun 151.Maddesinde düzenlenen “Mala Zarar Verme” suçunun teoride ve uygulamada; kapsamı ve niteliği yeniden değerlendirilmelidir. Bu sebeple mala zarar verme suçunun incelenmesi, değerlendirilmesi, uygulamada yaşanan durumun analiz edilmesi ve bunların sonucu olarak ne gibi yeniliklerin veya değişikliklerin getirilmesi bu tezimizle birlikte ileri sürülecektir. | en_US |
| dc.description.abstract | People have always wanted to protect their belongings and ensure their safety while living in society. This desire has led to the emergence and development of the concept of property. Property is a relationship of ownership established between a person and an object and accepted by others. Knowing who owns an object is important both individually and socially. Therefore, the concept of property has been addressed and regulated in both private law and public law with different aspects. While property rights express the widest authority of a person over a property in private law, the limits of property in public law are determined by the powers of the state and public interest. The purpose of all these regulations is to create a measure against the dangers that may arise against individuals' properties and to prevent the misuse of property. Legal regulations have been introduced to ensure the protection of individuals' properties against the dangers that may arise and to apply sanctions when necessary, completely to maintain public order and serve the public interest. The scope and nature of the crime of Damage to Property regulated in Article 151 of the Law No. 5237 should be re-evaluated in theory and practice. Therefore, this thesis aims to analyze and evaluate the crime of Damage to Property, examine the situation in practice, and propose what innovations or changes should be made as a result. | en_US |
