| dc.description.abstract | Marka, sahip olduğu önemli fonksiyonlar gereği 556 sayılı Markaların Korunması Hakkında Kanun Hükmünde Kararname ile koruma altına alınmıştır. İş bu KHK'nın belirlediği şartlara uyularak TPE nezdinde tescili sağlanan markaya karşı, KHK'nın 61. maddesi ve bu madde atfı ile 9. maddesine aykırı eylem ve diğer faaliyetleri KHK bir sonuca bağlamış ve md. 61/A ve devamı maddeleri ile hukuki ve cezai başvuru yollarını belirlemiştir. Söz konusu maddeler, hukuki ve ekonomik şartlar gereği 5833 sayılı yasa ile değişikliğe uğrayarak yeniden düzenlenmiştir.Bu çalışmamızın birinci bölümünde, markaya tecavüz hallerini düzenleyen 556 sayılı KHK'nın eski hali ile 5833 sayılı kanun ile yapılan değişiklikten sonraki yeni hali üzerinde karşılaştırılmalı olarak durulmuş, yasa ile getirilen yeni düzenlemeler ayrıntılı incelenip yargı uygulamalarına olası katkısı tartışılmıştır.İkinci bölümünde ise, marka hakkına tecavüz halinde marka hakkı sahibinin hukuki talepleri konusu 556 sayılı KHK çerçevesinde, doktrin ve Yargıtay kararları eşliğinde incelenmiştir.Üçüncü bölümünde ise, marka hakkına tecavüzün cezai boyutunu düzenleyen KHK nın 61/A maddesinin eski hali ile 5833 sayılı kanun ile yapılan değişiklikten sonraki yeni hali üzerinde karşılaştırılmalı olarak durulmuş, yasa ile getirilen yeni düzenlemeler ayrıntılı incelenip, doktrin ve Yargıtay kararları eşliğinde görüşler ortaya koyulmuştur. | en_US |
| dc.description.abstract | The brand was taken over in terms of important functions which the brand has with the executive of the protection of trade Marks. By conforming to the conditions which the executive order decides by TPE against registering the trademark with the 61. topic of the executive order and with reference of this topic, the executive order has adjuticated activities and actions against 9.topic and has determined application procedures as criminal and lawful with the topic 61/A and other topics.These topics have undergone changes and have been reordered in accordance with lawful and economic conditions with 5833 of the law.In the first part of this studying, the old version of 556 of the executive order and the new version of 556 of the executive order after changes with 5833 of the law have been compared and new arrangements with new law have been analysed in detail and its possible contribution to the judgement policies has been discussed.In the second part of this studying, the lawful demands of the owner of the brand have been investigated in terms of 556 of the executive order with the doctrine and the judgement of Supreme Court of Appeals in case of abusing of the trademark right.In the third part of this studying, the old version of the topic 61/A of the executive order which orders the criminal part in case of abusing of the trademark right and the new version of the topic 61/A of the executive order after changes with 5833 of the law have been compared, the new arrangements with the law have been analysed in detail and the thoughts have been put forward with the doctrine and the judgement of Supreme Court of Appeals. | en_US |
