| dc.description.abstract | Boşanma, eşlerin evlilik birliğini mahkeme kararıyla sona erdirme yollarından biridir. Türk Medeni Kanunu'nda boşanma sebepleri sayılmıştır. Evlilik birliğinin temelden sarsılması sebebiyle boşanma davasında eşler genellikle şiddet vakıasına dayanmaktadır. Şiddet kavramı, Dünya Sağlık Örgütü (WHO) tarafından "fiziksel güç veya iktidarın kasıtlı bir tehdit veya gerçeklik biçiminde bir başkasına uygulanması sonucunda maruz kalan kişide yaralanma, ölüm ve psikolojik zarara yol açması ya da açma olasılığı bulunması" şeklinde tanımlanmıştır. Dünyada kültürden kültüre ve dönemden döneme şiddetin tanımı, amacı ve yönelimi değişim göstermektedir. Boşanma davasında taraflardan birinin ileri sürdüğü vakıanın şiddet olarak değerlendirilmesi yargılamanın sonucunu etkilemektedir. Dolayısıyla, Doktrine ve Yargıtay uygulamasına göre şiddet kavramının nasıl ele alındığı oldukça önemlidir. Boşanma Davasında Şiddet adlı bu tez çalışmasında, şiddet kavramı ve boşanma davalarında şiddet olarak nitelendirilen davranışlar, Doktrin ve Yargıtay uygulamasına göre değerlendirilmiştir. Bu değerlendirme yapılırken boşanma kavramı, tarihi gelişimi, benzer davalardan farkı, boşanma sebepleri, ulusal ve uluslararası alanda şiddetin tanımı, şiddetin ispatı, deliller ve hukuka aykırı deliller ele alınmıştır. | en_US |
| dc.description.abstract | Divorce is one of the ways to end the marriage union of the spouses with a court decision. The reasons for divorce are listed in the Turkish Civil Code.
