| dc.description.abstract | Çocuk ile baba arasındaki soybağı; anne ile evlilik, tanıma, hakim hükmü ve evlat edinme yoluyla kurulabilir. Babalık davası; anne ve/veya çocuk tarafından, çocuğun biyolojik babası olduğu iddia edilen erkeğe karşı açılmaktadır. Davanın açılabilmesi için çocuk ile başka bir erkek arasında soybağı ilişkisinin bulunmaması gerekmektedir. Çocuğun başka bir erkekle soybağı ilişkisi varsa biyolojik baba ile çocuk arasında tanıma yoluyla soybağı ilişkisi kurulamamaktadır. Soybağının reddi davasında da biyolojik babaya ancak ikincil nitelikte bir dava hakkı tanınmıştır. | |
| dc.description.abstract | The paternity between the child and the father is established through; marriage with the mother, recognition, judgment and adoption. Paternity case; can be sued by the mother and/or child against the man who alleged to be the child's biological father. In order to file the lawsuit, there should be no existing relationship between the child and another man. If the child has a paternity relationship with another man, the kinship relationship cannot be established through recognition between the biological father and the child. The biological father is granted only a secondary right to file rejection of paternity case. | |
