Özet
İdarenin üstlendiği görevleri başarıyla ve gereği gibi yerine getirebilmesi istihdam ettiği insanların hem nicelik, hem de nitelik yönünden yetenekli kişilerden oluşmasına bağlıdır. Anayasa'ya göre, "her Türk kamu hizmetine girme hakkına sahiptir. Hizmete alınmada, görevin gerektirdiği niteliklerden başka hiçbir ayrım gözetilemez". Türk pozitif hukukunda memurluğa giriş ve yükselmede liyakat sistemi benimsenerek tarafsız bir memuriyet sistemi oluşturulmaya çalışılmıştır. Liyakat, kamu görevlerine girmeyi, sınıflar içinde ilerlemeyi ve yükselmeyi, görevin sona ermesini liyakat sistemine dayandırmak ve bu sistemin eşit imkanlarla uygulanmasında devlet memurlarını güvenliğe sahip kılmaktır. Bu çalışmada, kamu hizmetine girme hakkı ve liyakat ilkesi açısından istisnai memurluklar ele alınacaktır. İstisnai memurluk, DMK'nın atama, sınavlar, kademe ilerlemesi ve derece yükselmesine ilişkin düzenlemeleri dışında özgülenen ve derece aylığı ile atama yapılabilen memurluklardır.
The success of administration depends on the quality and quantity of staff hired. According to the Constitution: ?Every Turk has the right to enter public service. No criteria other than the qualifications for the office concerned shall be taken into consideration for recruitment into public service.? In the Turkish positive law, it had been aimed to form a civil servancy system which is neutral having the rules of career, merit and classification in entering and promoting the civil servants.The merit rule aims entering the public service, promoting among the classes and completing the service duty to base upon the right of deserving and equality so that the civil servants have the feeling of security. In this study, the exceptionary civil servants be dealed from the view point of merit rule and entering the public service. The exceptionary civil servant is a type of civil servancy out of the general rule that is regulating the civil servants called DMK.
