| dc.description.abstract | 1982 Anayasası, sadece anayasa hukukçuları ve siyaset bilimciler tarafından değil, toplumun geniş bir kesimi tarafından, hem anti demokratik hazırlanış biçimi hem de otoriter ve yasakçı içeriği bakımından ağır biçimde eleştirilmektedir. Bu amaçla son bir yıldır yeni anayasa çalışmaları başlamıştır. Günümüze kadar birçok değişikliğin olduğu 1982 anayasasına bakılarak getirilecek yeni anayasanın ne gibi değişiklikler içerdiği ve getirilecek maddelerin neler olduğu büyük merak konusu olmuştur. Bilindiği gibi, devletin tüm eylem ve işlemlerinin yargı denetimine açık olması, yargının bağımsız ve tarafsız olması, temel hak ve özgürlüklerin herkes için korunması, hukuk önünde eşitlik ve hak arama yollarının açık olması gibi unsurlar, bir hukuk devletinin en önde gelen gerekleri arasında yer almaktadır. Bu çerçevede bakıldığında, yapılan Anayasa değişikliklerinin tamamının, Türkiye'de hak ve hürriyetleri teminat altına alan ve hukuk devletinin gereklerini biraz daha yerine getiren, güçlen¬diren düzenlemeler olduğu görülmektedir.
