Özet
Bir toplumun birlikte yaşama arzusundan kaynaklanan belirli yazılı kurallarla çerçevesi çizilmemiş ilişkiler ağı, her ne kadar yakın zamanlarda yazılı hukuk ile içli dışlı olsa da genel anlamda halk hukuku diye adlandırılabilecek yazılı olmayan kurallar silsilelerine bağlıdır. Dine, siyasi ilişkilere ve zamana bağlı olarak değişen ve gelişen Türk halk hukuku, genel anlamda, geleneksel halk hukuku, İslam hukuku ve modern hukuk üçlemesi üzerine temellendirilebilir. Makale, halk hukuku ve köy odaları üzerine yapılmış bir yüksek lisans tezinden hareketle Orta Anadolu’da yer alan yaklaşık iki yüz hanelik bir Türk köyünün binlerce yıllık gelenekleriyle şekillenmiş mevcut halk hukuku uygulamalarını köy odaları üzerinden çözümlemeyi amaçlamaktadır. Bu bağlamda halk, hukuk, halk hukuku, töre-adet-gelenek gibi kavramlarıyla da ilişkili olan halk hukukunun oda efradı üzerinden bir araştırması olan makale; uygulama, kabul ve yöntemlerin ana hatlarıyla bir çerçevesini çizmeye çalışmaktadır. Ayrıca çalışmanın sonuç bölümünde, güncel bir mesele olarak da yeniden yapılanma sürecine giren Türk hukuk sistemi için, halkın hukuk algısı üzerinden, halkın hukuki beklentilerine cevap verilebilecek bir hukuk sisteminin yollarının açılabilmesine yönelik bazı çözümlemeler de bulunmaktadır.
The relations network, which are not framed by the specific written rules and stemmed from the society’s desire of living together, depends on the series of unwritten rules, which can be generally called public law although it is hand in glove with written rules recently. Turkish public law, which is changing and developing relying on religion, political relationships, and time, is typically grounded in the triangulation of traditional public law, Islamic law, and modern law. The current study aims to analyze the existing public law practices of a 200-household Anatolian village, which is located in the middle Anatolia and whose practices have been shaped for thousands of years. In this regard, this article is a study of public law, which is closely related with the concepts such as public, law, public law, moral laws, customs, and traditions, based on the individuals of village chamber. The current study aims to draw a general framework of the practices, adoptions, and methods. In addition, in the conclusion part of the study, some interpretations were made based on the law perceptions of the public to explain and lead the law system that can respond to the expectations of the public from the Turkish law system, which is, as a current issue, in a restructuring process.
