Özet
Gerçek kişilerde kişilik, sağ ve tam doğmak şartıyla hemen kazanılır. Kişiliğin sona ermesi ise hukukî varlığın ortadan kalkmasıdır. Kişiliğin sona ermesinden önce sahip olunan hak ve borçlar, mirasçıları ilgilendirir ve Miras Hukukunun konusuna girer. Kişiliği sona erdiren doğal sebep ölümdür. Ancak Medenî Kanunumuz bunun yanında gaipliği de kişiliği sona erdiren bir sebep olarak kabul etmiştir.
In natural persons, personality is directly acquired in condition of alive and precise birth. However, the expiration of personality is the disappearence of judical presence. The rights and depts that the person possesses before the expiration of personality concerns the heir persons and becomes the matter of law of decendent's estate. The natural reason that expires the personality is death. However; our civil law accepts the disappearence as a reason that expires the personality, too.
