Faks yoluyla gönderilen istinaf dilekçesinin süresinde ulaşıp ulaşmadığının tespiti, sadece gönderilen sinyallerin istinaf süresinin geçmesinden önce mahkemenin faks aleti tarafından tamamen belleğe alınıp (kaydedilip) alınmadığına bağlıdır.
