Özet
Adil yargılanma hakkının, yargılamanın her aşamasında gözetilmesi hukuk devletinin gereğidir. Adil yargılanma hakkının muhteviyatında yer alan müdafiden yararlanma hakkı da, bireysel savunmanın yetersizliğinden hareketle, şüpheli veya sanığın etkin bir savunma imkanına sahip olmasını sağlamaya yönelik bir haktır. Çalışmamızda; müdafiden yararlanma hakkı, müdafiin hukuki statüsü ve özellikle de zorunlu müdafiliği gerektiren haller güncel yargı kararları ışığında inceleme konusu yapılmaktadır.
Observing the right to a fair trial at every stage of the trial is requirement of the state of law. The right to benefit from a lawyer, which is included in the content of the right to a fair trial, is also a right to ensure that the suspect or the accused has an effective defense opportunity, based on the inadequacy of individual defense. In our study; the right to benefit from a lawyer, the legal states of lawyer and especially the situations that require compulsory defense are examined in the light of current judicial decisions.
