dc.description.abstractGaipliğin şartlarını temel olarak “medeni kanunun aradığı olaylardan birinin mevcut olması”, “belirli bir sürenin geçmiş olması”, “ölümün kuvvetle muhtemel görünmesi”, “ilgililerin talepte bulunması” ve “mahkemenin gaipliğe karar vermesi” olmak üzere beş ayrı başlık altında ele alabiliriz. Gaiplik kararı ile birlikte birçok hukukî sonuç ortaya çıkar. Örneğin, gaipliğine karar verilen kimsenin nişanlılığı kendiliğinden sona erer. Buna karşılık, gaipliğine karar verilen kimsenin evliliği kendiliğinden sona ermez. Böyle bir durumda, gaibin eşi, evliliğini devam ettirip ettirmeme hakkına sahiptir. Ayrıca, evliliğin feshedilmesine gerek kalmaksızın eşlerden birinin gaipliğine karar verilince edinilmiş mallara katılma rejimi sona erer. dc.description.abstractWe can examine the conditions of disappearance basically under five different headings as "the existence of one of the events that the civil law seeks", "passing of a certain period of time", " being of very high probably of death", "attendance of interested persons" and "the decision of the disapperance". With the decision to disappear, many legal consequences arise. For example, the engegament of anyone given the decision of disappearance ends by automatically. On the other hand, the marriage of the person who has been decided to disappear does not automatically end. In such a case, the spouse of the person who has disappeared has the right to resume or end marriage. Also, without the need to terminate the marriage, when one of the spouses is decided to disappear, regime of participation in acquired property ends. However, the right of the custodian ceases when the mother or father or one of them is disappearance. When the person under guardianship disappears, the guardianship ends automatically. Again in terms of the person who has disappeared, it may be possible to appoint management.en_US
