| dc.description.abstract | Devlet başkanlarının yetki ve sorumlulukları hususu hükûmet sistemlerine göre farklılık göstermektedir. Sorumluluk türleri hukuki, cezai ve siyasi sorumluluk olarak üç ana başlıkta incelenmektedir. Hükûmet sistemlerinin yapılarına göre devlet başkanlarının sorumlulukları azalmakta ya da artmaktadır. 1982 Anayasası’nda 2017 yılında yapılan değişiklik sonucunda hükûmet sistemi değişmiştir. Yeni oluşan hükûmet sistemi kendine özgü özellikler barındırmaktadır. Hükûmet sistemi ile beraber devlet başkanının sorumlulukları da değişmiştir. Parlamenter sistemdeki temsili Cumhurbaşkanının yerini aktif bir Cumhurbaşkanı almıştır. 16 Nisan 2017 tarihinde yapılan referandum sonucu Anayasa’nın 105. maddesinin başlığı “sorumsuzluk ve sorumluluk hali” iken “cumhurbaşkanının cezai sorumluluğu” olarak değiştirilmiştir. Bununla beraber Cumhurbaşkanının siyasi, hukuki ve cezai sorumluluğu değişmiştir. Değişiklik ile yargılama usulü ve sonucu da düzenlenmiştir. 24 Haziran 2018 tarihinde yapılan TBMM ve Cumhurbaşkanlığı seçimi sonunda Cumhurbaşkanının yemin etmesiyle yeni hükûmet sistemi uygulanmaya başlanmıştır. | |
| dc.description.abstract | The powers and responsibilities of heads of state vary according to government systems. Types of responsibility are examined under three main headings: legal, criminal and political. According to the structures of government systems, the responsibilities of heads of state are decreasing or increasing. The government made the 1982 Constitution made in 2017 changed the government system. The newly formed government system has unique features. With the government system, the responsibilities of the head of state have changed. The representative president in the parliamentary system has been replaced by an active president. As a result of the referendum held on 16 April 2017, the title of Article 105 of the Constitution was changed from hali state of irresponsibility and responsibility ”to criminal responsibility of the president”. However, the political, legal and criminal responsibility of the president has changed. The procedure and result of the amendment were also regulated. At the end of the parliamentary and presidential elections held on June 24, 2018, the new government system was implemented with the swearing of the President. | |
