Çatılı İşyeri Kira Sözleşmelerine Yüksek Enflasyonun Etkisi

Özet
Ani fiyat artışları, paranın değerinde meydana gelen azalma ve dolayısıyla enflasyonun yüksek seyretmesi kira bedellerinin kısa sürede artmasına neden olmuştur. Türkiye İstatistik Kurumu Mart 2023 verileri uyarınca on iki aylık ortalamalara göre Tüketici Fiyat Endeksi değişim oranı yüzde 70,20 olarak belirlenmiştir. Buna karşılık çatılı işyeri kira sözleşmeleri, 8 Haziran 2022 tarihli 7409 Sayılı Kanun’a eklenen 4’üncü maddesi ile 6098 Sayılı Türk Borçlar Kanunu’na eklenen geçici maddenin öngördüğü yüzde 25’lik kira artış sınırlandırmasının kapsamı dışındadır. Ayrıca uygulamada kira bedellerinin tüketici fiyat endeksini dahi aşar şekilde işyeri kiracısına dayatıldığı bilinmektedir. Bu çalışmada, enflasyon oranındaki aşırı artışın mevcut çatılı işyeri kira sözleşmelerine olası etkileri değerlendirilmektedir. Böylece hukuk uygulamasına katkı sağlamak amaçlanmaktadır. Çalışma kapsamında yüksek enflasyonun çatılı işyeri kira sözleşmelerine etkisi; kira bedeli artışı, sözleşmenin uyarlanması ve kira sözleşmesinin önemli sebeple olağanüstü feshine ilişkin hükümler uyarınca incelenmektedir. Sudden price increases, the devaluation of the currency and therefore the high course of inflation have caused rental prices to increase in a short period of time. According to the Turkish Statistical Institute March 2023 data, the rate of change in the Consumer Price Index according to twelve-month averages was determined as 70.20 percent. On the other hand, roofed business premises lease contracts are outside the scope of the 25 percent rent increase limitation stipulated by the provisional article added to the Turkish Code of Obligations No. 6098 with Article 4 added to Law No. 7409 dated June 8, 2022. In addition, it is known that in practice, rental prices are imposed on business premises lessees even exceeding the consumer price index. In this study, the potantial effects of the excessive increase in the inflation rate on existing roofed business premises lease contracts are evaluated. Thus, it is aimed to contribute to the legal practice. Within the scope of the study, the effect of high inflation on roofed business premises lease contracts is analysed in accordance with the provisions on rent increase, adjustment of the contract and extraordinary termination of the lease contract for significant reasons.
