Özet
Genel işlem koşulları, günümüzde bankacılık, sigortacılık, seyahat ve taşıma işleri gibi birçok alanda kullanılan sözleşmelerde yer almaktadır. Ancak, Türk Hukukunda 6098 sayılı Borçlar Kanunundan önce genel işlem koşulları hakkında herhangi bir genel hüküm mevcut değildi. 4077 sayılı Tüketicinin Korunması Hakkında Kanunda ise, genel işlem koşulları sadece tüketici sözleşmeleri bakımından düzenlenmişti. Bu eksiklik, 6098 sayılı Borçlar Kanunu ile giderilmiştir. Buna göre, genel işlem koşulları, Borçlar Kanununun 20 ilâ 25 inci maddeleri arasında ayrıntılı bir şekilde düzenlenmiş ve sınırlandırılmıştır. Dolayısıyla, Borçlar Kanunundaki genel işlem koşullarına ilişkin hükümlerin, artık bu koşullara yer verilen her tür sözleşmede uygulanması mümkündür. Borçlar Kanununda, önce genel işlem koşulunun tanımına yer verilmiştir. Sonra ise, genel işlem koşullarının denetimi düzenlenmiştir. Bunlar, yürürlük denetimi, yorum denetimi ve içerik denetimidir.

Thus, the legal p rovisions relating to the general transaction conditions in The Code of Obligations no 6098 are p ossible to be p ut in p ractice f or the all contracts which give p lace to these conditions. The defi nition of the general transaction condition is taken p lace fi rstly in The Code of Obligations no 6098. Then, the control of the general transaction conditions are p ut in order in The Code of Obligations. The sp ecies of the general transaction conditions are the control f or the op eration, the control f or the interp retation and the control f or the content.
