| dc.description.abstract | Türk Medenî Kanunu 185 ve devamı maddelerinde, eşlere kural olarak evlilik birliği süresince karşılıklı dayanışma ve yardımlaşma ödevi yüklenmiştir. Bu ödev kural olarak evlilik birliğinin devamı süresince aranmış, istisnai bazı yükümlülüklerin evlilik birliğinin sona ermesi halinde de devam edeceğine ilişkin düzenlemeler getirilmiştir. Evlilik birliğinin, boşanma kararıyla ortadan kalkmasıyla beraber, ortaya çıkan hukuki sonuçlarından biri olarak “yoksulluk nafakası” düzenlenmiştir. Çalışmada, boşanmanın eşler bakımından kişisel ve mali hukuki sonuçları, mali sonuçlarından biri olan yoksulluk nafakası ele alınmıştır. Çalışmada ayrıca yoksulluk nafakasının süresizliği, İsviçre Medeni Kanunu çerçevesindeki değerlendirmeler ve Türk Hukukunda yoksulluk nafakasına ilişkin düzenlemelere yöneltilen eleştirilere yer verilmiştir. | |
| dc.description.abstract | In articles 185 and its continuation of the Turkish Civil Code, as a rule, spouses are given a duty of mutual solidarity and cooperation during the marriage union. This assignment was sought as a rule during the continuation of the marriage union, and arrangements were introduced that some exceptional obligations would continue if the marriage union ended. With the disappearance of the marriage union by divorce decision, "poverty alimony" was arranged as one of the legal consequences. In the study, the personal and financial legal consequences of divorce in terms of spouses and poverty alimony, which is one of the financial consequences, were discussed. The study also includes criticisms of the indefiniteness of poverty alimony, assessments within the framework of the Swiss Civil Code and regulations on poverty alimony in Turkish Law. | |
