556 Sayılı Kanun Hükmünde Kararnameye Göre Marka Olarak Tescil Edilebilecek İşaretler

Özet
Marka olarak tescil edilebilecek işaretler 556 sayılı Markaların Korunması Hakkında Kanunu Hükmünde Kararname (KHK/556)?nin 5. maddesinde düzenlenmiştir. KHK/556 m.5’de marka olarak tescil edilebilecek işaretler sayılmıştır. Ancak bu sayım tahdidi olarak yapılmamıştır. Diğer bir deyişle maddede yer almayan işaretlerin de bazı şartları gerçekleştirmeleri ve ayırt ediciliği sağlamaları koşuluyla marka olarak tescil edilebilecekleri kabul edilmiştir. Dolayısıyla KHK/556, bazı şartlar getirmiş olmasına rağmen marka olabilecek işaretleri oldukça geniş bir kapsamda değerlendirmiştir. Bu kapsam çerçevesinde kişi adları, sözcükler, resimler, fotoğraflar, şekiller, logolar, armalar, harfler, sayılar, üç boyutlu cisimler, renkler, sesler, kokular, hizmet işaretleri ve diğer bütün fikri mülkiyet işaretleri marka olarak tescil edilebilmektedir.
Signs that can be registered are prepared on the section 5 in the decree law on the protection of Trademarks (KHK/556). In the decree law on the protection of Trademarks numbered 556 section 5, signs that can be registered are put in order. But this is not limited. In other words, on condition that the signs that are not mentioned in the aforesaid article should materialize certain provisions and ensure distinction, it has been agreed that they can be registered as a trademark. Accordingly, although KHK/556 has stipulated certain conditions, such signs thereof as are likely to be trademarks have been evaluated on quite a vast scale. Within the frame of this coverage, personal names, words, pictures, photos, figures, logos, arms, letters, numbers, three-dimensional materials, colours, sounds, smells, service signs and all other signs of intellectual property can be registered as a trademark.
