dc.description.abstractSigorta sözleşmesinin kurulması herhangi bir şekle bağlı tutulma-mıştır. Ancak Türk Ticaret Kanunu m. 1405’te sigorta sözleşmesininkurulmasına ilişkin bir hüküm yer almıştır. Bu hükme göre sigorta etti-ren tarafından teklifname verilerek yapılan öneriye, sigortacı otuz günboyunca sessiz kalmışsa, sigorta sözleşmesi kurulmuş sayılacaktır. Do-layısıyla sigorta sözleşmesi açısından susma, kabul beyanı olarak nite-lendirilmiştir. Sigorta sözleşmesinin susma yoluyla kurulmasına ilişkinhükümde “teklifname” kavramından ve otuz günlük süreden bahsedil-miştir. Teklifname kavramının kullanılması ile hükmün önerinin yazılıolarak yapıldığı hâlleri kapsadığı söylenebilir. Bunun yanında sözleşme-nin kurulması için gerekli olan otuz günlük sürenin de uzun olduğu ilerisürülebilir.en_US
dc.description.abstractThe establishment of an insurance contract hasn’t been dependingon any form. However in Article 1405 of the Turkish Commercial Code,a clause regarding the establishment of the insurance contract was stip-ulated. According to this clause, if the policyholder has remained silent for thirty days, the insurance contract the contract shall be deemed tohave been established. Therefore, silence in terms of insurance contractis considered as a declaration of acceptance. in Article 1405 of theTurkish Commercial Code will be valid where the proposal is made bythe policyholder. The clause regarding the establishment of the insur-ance contract through silence has been mentioned in the concept of pro-posal and thirty days. It can be said that the use of the concept of pro-posal covers the situations in which the offer is made in writing. Besidesit can be asserted that the thirty day period required for the establish-ment of the contract is long.en_US
