Özet
Çalışmamızda mahkemeler tarafından yazılı ve görsel basın araçları için verilen yayın yasağı kararlarının ifade ve basın özgürlüğü açısından hukuki temelleri araştırılmakta ve hangi hallerde yayın yasağı kararının verilebileceği Anayasa başta olmak üzere ilgili yasaların maddeleri ele alınarak irdelenmektedir. Konuyla ilgili uygulama çalışması olarak yazılı basının Ergenekon soruşturmasına olan ilgisi içerik çözümlemesi yöntemi kullanılarak araştırılmaktadır. Konunun güncelliği göz önünde bulundurularak yazılı basının Ergenekon soruşturması ile ilgili yayın yasağına uygun davranıp davranmadıkları araştırılıp genel bir değerlendirme ile çalışmamız sona ermektedir.
In our study legal basis of broadcasting prohibitions which are adjudicated by courts to written and visual media are investigated according to expression and freedom of the press and in which case the decision to ban publications such as the Constitution can be addressed by the relevant provisions of law are examined. Written applications to work on the subject of press interest in the Ergenekon investigation, by using content analysis methods are investigated. By keeping in mind actuality of the subject, whether the written presses respect broadcasting prohibitions or not about the Ergenekon Investigation are investigated and ended with an overall evaluation study.
